These Terms and Conditions ("Terms") govern the provision of black and white printing services ("Services") by Shekhar ("We," "Us," or "Our") to the customer ("You" or "Customer"). By placing an order for Services, you agree to be bound by these Terms.
1. Service Description
1.1. Scope of Services: We provide black and white printing services, which include converting digital files into physical prints using monochromatic ink (black, grayscale). This may include, but is not limited to, documents, reports, booklets, flyers, and other materials specified in your order.
1.2. Print Quality: We endeavor to produce high-quality black and white prints based on the files provided by the Customer. Factors such as original file resolution, image quality, and appropriate formatting will directly impact the final print output. We are not responsible for print quality issues arising from low-resolution or improperly formatted source files.
1.3. Material Specifications: We will use standard B2B Copier 70 GSM A4 white paper unless otherwise agreed upon in writing. Special paper requests may incur additional charges and require pre-approval.
2. Order Placement and Acceptance
2.1. Order Submission: Orders for Services can be placed through our website, email, WhatsApp and in-person. You must order at least 10 copies or 10 pages and provide all necessary information, including file uploads, quantity, and any specific instructions.
2.2. File Requirements: All files submitted for printing must be in a commonly accepted format (e.g., PDF, JPG). We recommend PDF for optimal results. You are responsible for ensuring the accuracy, completeness, and print-readiness of your submitted files. We reserve the right to refuse files that are corrupt, unprintable, or deemed inappropriate.
2.3. Order Confirmation: An order is deemed accepted only when we send a written confirmation (e.g., email confirmation) to you. We reserve the right to decline any order at our sole discretion.
2.4. Amendments/Cancellations: Once an order is confirmed, amendments or cancellations may not be possible, or may incur charges, especially if printing has already commenced. Any requests for changes or cancellations must be made in writing and are subject to our approval.
3. Pricing and Payment
3.1. Pricing: Prices for Services will be as quoted at the time of order placement or as listed on our website/price list. Prices are subject to change without prior notice, but any changes will not affect orders already confirmed.
3.2. Taxes: All prices are inclusive of all taxes as applicable, unless otherwise stated. Applicable taxes will be added to the total invoice amount.
3.3. Payment Terms: Full payment should be made at the time of confirmation of order. We accept payment via UPI, bank transfer, cash.
3.4. Late Payment: We reserve the right to charge interest on overdue payments at a rate of the maximum rate permitted by law, from the due date until full payment is received. We may also suspend or terminate Services for late payment.
4. Turnaround Time and Delivery/Collection
4.1. Estimated Turnaround: We will provide an estimated turnaround time for your order. This is an estimate only and not a guarantee. Delays may occur due to unforeseen circumstances, equipment malfunction, or high volume.
4.2. Notification: We will notify you when your order is ready for collection or has been dispatched for delivery.
4.3. Collection: If you choose to collect your order, you must do so within 7 working days of notification. Uncollected orders may be subject to storage fees after a certain period.
4.4. Delivery: If you opt for delivery, we will use Speed Post or Registered Post. Delivery charges will be extra and clearly communicated. We are not responsible for delays or damages caused by the delivery carrier once the order has left our premises. Risk of loss and damage passes to you upon delivery.
5. Intellectual Property and Content
5.1. Your Content: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to print the content you submit.
5.2. Indemnity: You agree to indemnify, defend, and hold us harmless from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with any claim that the content you provide infringes on the intellectual property rights or other rights of any third party.
5.3. Prohibited Content: We reserve the right to refuse to print any content that we deem to be unlawful, obscene, defamatory, harassing, discriminatory, or otherwise inappropriate.
6. Limitation of Liability
6.1. General: To the maximum extent permitted by law, our total liability to you for any and all claims arising out of or in connection with these Terms or the Services, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the specific Services giving rise to the claim.
6.2. Indirect Damages: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.
6.3. Force Majeure: We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
7. Returns and Refunds
7.1. Print Errors (Our Fault): If there is a demonstrable error in printing that is directly attributable to our fault (e.g., wrong paper type used, significant print defects not present in the original file), you must notify us within 3 working days of receiving your order. We will, at our sole discretion, either reprint the order or provide a pro-rata refund.
7.2. Customer Errors: We are not responsible for errors in printing arising from mistakes in the files submitted by you (e.g., typos, incorrect formatting, low-resolution images). No refunds or reprints will be provided for such errors.
7.3. Color/Shade Variation: While we strive for consistent black and white output, minor variations in black density and grayscale shades may occur between prints due to the nature of digital printing. These variations do not constitute a defect and will not qualify for a reprint or refund.
8. Data Protection and Privacy
8.1. Privacy Policy: We will collect and process your personal data in accordance with our Privacy Policy, which is available at https://www.askshekhar.com/privacy-policy.
8.2. File Retention: We generally do not retain customer files after an order is completed, unless explicitly agreed upon for future reprints or for a specific period as part of an ongoing service agreement. You are responsible for backing up your original files.
9. Governing Law and Dispute Resolution
9.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Government of India.
9.2. Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good faith negotiations between the parties. If a resolution cannot be reached, the dispute shall be submitted to the District Court in Malda, India, in accordance with the rules of [specify arbitration body, if applicable].
9.3. Jurisdiction: Subject to the dispute resolution clause, the courts of Malda Jurisdiction shall have exclusive jurisdiction to hear and determine any action or proceeding arising out of or in connection with these Terms.
10. General Provisions
10.1. Entire Agreement: These Terms constitute the entire agreement between you and us concerning the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
10.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.3. Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
10.4. Amendments: We reserve the right to amend these Terms at any time by posting the revised Terms on our website https://www.askshekhar.com/. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
10.5. Headings: The headings in these Terms are for convenience only and shall not affect their interpretation.
